4. POOL TRADING STRUCTURE & VOLUNTARY PARTICIPATION

Participation in our pool trading arrangements is entirely voluntary. By participating, you acknowledge:

• Pool trading is a collective voluntary arrangement, not a regulated investment product
• Jahir Trade Guide acts as a trading coordinator, not a fund manager or broker
• You are trading with your own capital at your own discretion
• Participation is based on mutual agreement and trust
• You have independently chosen to participate with full understanding of risks
• No guarantee exists regarding profitability or success of trades

5. ASSUMPTION OF RISK & LIABILITY WAIVER

By using Jahir Trade Guide services:

• You assume full, absolute responsibility for all trading losses
• You acknowledge that trading is inherently risky and loss is possible
• You waive any claim against Jahir Trade Guide for trading losses
• You understand price volatility can result in rapid losses
• You accept that past performance does not guarantee future results
• You waive liability claims arising from market conditions, leverage, or execution

6. LIMITATION OF LIABILITY

• Any trading losses, financial losses, or monetary damages
• Direct, indirect, incidental, consequential, special, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Errors, omissions, delays, or inaccuracies in trading signals or information
• System failures, service interruptions, or technical issues
• Incorrect execution of trades or orders
• Market movements or price fluctuations
• Leverage-related losses or forced liquidation
• Third-party broker actions or failures
• Force majeure events or unforeseen circumstances

The total liability of Jahir Trade Guide for any claim shall not exceed the amount paid by you for services in the prior 30 days, if any.

7. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Jahir Trade Guide and its owners, operators, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use of our services or pool trading participation
• Your trading decisions or activities
• Your breach of these Terms and Conditions
• Your violation of applicable laws or regulations
• Claims by third parties related to your activities

8. RISK ACKNOWLEDGMENTS

You acknowledge and understand the following risks:

• Market Risk: Markets are unpredictable; prices can move dramatically in any direction
• Leverage Risk: Using leverage amplifies both gains and losses
• Liquidity Risk: Assets may not be sold quickly or at expected prices
• Execution Risk: Orders may not execute at anticipated prices or times
• Technology Risk: Systems may fail; connectivity may be lost

• Pool Risk: Collective losses are shared; decisions affect all participants

Jahir Trade Guide provides all services and information on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including:

• Warranties of profitability, success, or positive returns
• Warranties that services will be uninterrupted or error-free

• Warranties against infringement or third-party interference
• Any warranty that results will meet your expectations

10. USER ELIGIBILITY & REPRESENTATIONS

By using our services, you represent and warrant that:

11. PROHIBITED USES

You agree not to:

• Transmit viruses, malware, or harmful code

12. PAYMENT & REFUND POLICY

• Neither party is responsible for third-party payment processor failures
• You are responsible for all fees, taxes, and charges imposed by your bank or payment provider

15. THIRD-PARTY SERVICES & BROKERS

• We are not responsible for broker actions, errors, or failures
• Broker terms and conditions apply independently
• Trade execution depends on broker systems and markets
• Jahir Trade Guide does not guarantee trade execution
• Slippage, re-quotes, and rejections may occur

16. TERMINATION & ACCOUNT CLOSURE

• Jahir Trade Guide may terminate services at any time without cause
• Termination does not affect existing obligations or liability waivers
• Upon termination, you must cease all use immediately
• Remaining balances may be returned within 30 business days
• Termination does not require advance notice in cases of legal violations

17. MODIFICATIONS TO TERMS

• Jahir Trade Guide may modify these Terms at any time
• Modified terms become effective upon posting
• Continued use constitutes acceptance of modified terms
• Material changes may be communicated via email
• You are responsible for reviewing updated terms regularly

18. DISPUTE RESOLUTION & GOVERNING LAW

• These Terms are governed by the laws of the United Kingdom
• You expressly waive any right to legal proceedings or litigation
• All disputes must be resolved through binding arbitration

• You waive any right to jury trial, class action, or appeal

• You have no access to the Financial Ombudsman Service

20. KYC/AML COMPLIANCE

• Jahir Trade Guide may require Know Your Customer (KYC) information
• Anti-Money Laundering (AML) policies may be enforced
• Suspicious activity may be reported to authorities
• Account restrictions may apply due to compliance requirements
• You consent to identity verification and background checks

21. COMMUNICATIONS & NOTIFICATIONS

• You consent to electronic delivery of notices
• You are responsible for keeping contact information current
• Missed communications do not invalidate these Terms
• Urgent communications may be sent to last known contact

22. SEVERABILITY

The following provisions shall survive any termination or expiration: No Financial Advice Disclaimer, Assumption of Risk & Liability Waiver, Limitation of Liability, Indemnification, Intellectual Property Rights, Governing Law, and any other provisions concerning your obligations or our rights.
